If you have an apartment (flat) in an Apartment Complex, and you have rented it out, then in most Apartment Complexes or Housing Societies, you are required to pay an additional "non-occupancy" charge, over the regular maintenance charges. I am trying to get an idea of what is the average rate of non-occupancy charges for Apartment Complexes in the Aundh/Baner area.

I understand that for Housing Societies, the non-occupancy charges are legally mandated to be no more than 10%. However, Apartment Complexes ("Association of Apartment Owners") are free to charge more.

If you have a flat in an Aundh/Baner apartment complex, and happen to know the non-occupancy charges, let me know. Please include the following information:

  • Name & Location of the Apartment Complex
  • Rate of non-occupancy charge, as a percentage of the maintenance charges. If it is not being charged as a percentage of maintenance, then please indicate how the amount is calculated.
  • What fraction of the flats are rented out (as opposed to being occupied by owners).

(Note: only interested in Association of Apartment Owners; don't need data for Housing Societies.)

AFAIK Apartment complexes cannot charge more than 10%. That was an issue that came up in our apartment AGM and it was clearly clarified that 10% was the upper limit by law. Not sure whats the fraction that are rented out but that imo should not be relevant.

As far as I understand, the law prescribes that a Housing Society cannot charge more than 10%. Unfortunately, the law is silent on this matter as far as Association of Apartment owners is concerned.

The fraction rented out could be relevant because some people are arguing that more rented out flats implies higher maintenance costs (more heavy furniture being moved via lifts, more security issues, etc), and hence a higher non-occupancy charge is justified. (I'm not saying I buy this argument - just pointing out that it was made...)

Sahadeo Heights, near Rajwada Hotel, Baner Road has 0 non-occupancy charges. They tried levying but weren't able to get the resolution passed.

Tiara, on Baner Road (near Green Park), used to charge 25%, but had to reduce it to 10% after complaints.
